Our review of six markets where Truerix employs people found five recurring compliance themes:

Work permits are the critical path. Expatriate approvals take 4–12 weeks in most markets and usually require proof that no local candidate is available, plus a local understudy or succession plan.

Localisation is enforced, not optional. South Africa's employment equity targets, Nigeria's expatriate quota, Tanzania's succession plans and Botswana's localisation policy all shape who you can hire and for how long.

Data protection laws now have teeth. All six markets have data protection laws, and Kenya and Tanzania require employers to register with the regulator before processing employee data.

Fixed-term and outsourced labour is being restricted. Tunisia banned labour subcontracting in 2025, Botswana capped fixed-term contracts at 12 months from July 2026, and Kenyan and South African courts increasingly reclassify long-term contractors as employees.

Monthly filings are unforgiving. Payroll tax and social security deadlines fall between the 7th and 15th of the following month, with penalties and interest from the first day of delay.

The six markets at a glance

Market

Key employment law

Expat work authorisation

Localisation rule

Data protection law

Truerix presence

South Africa

BCEA, LRA, Employment Equity Act

Critical Skills, General Work or ICT visa

Employment equity targets; B-BBEE

POPIA (Information Regulator)

Own entity

Botswana

Employment and Labour Relations Act 2025

Work and residence permit

Localisation and understudy plans

Data Protection Act 2024

Own entity

Nigeria

Labour Act; Pension Reform Act

Expatriate quota + STR visa + CERPAC

Expatriate quota; local content in oil and gas

Nigeria Data Protection Act 2023

Own entity

Kenya

Employment Act 2007

Class D work permit

Understudy and localisation conditions

Data Protection Act 2019 (registration required)

In-country coverage

Tanzania

Employment and Labour Relations Act

Class B work permit + residence permit

Succession plan; 5-year limit

Personal Data Protection Act 2022 (registration required)

In-country coverage

Tunisia

Labour Code; Law 2025-9

Ministry contract approval + residence card

Limits on foreign staff

Organic Law 2004-63 (INPDP)

Own entity

Monthly and annual filing calendar

Market

Monthly

Annual / periodic

South Africa

PAYE, UIF and SDL on EMP201 by the 7th

EMP501 reconciliations twice a year; IRP5 certificates

Botswana

PAYE to BURS by the 15th

Annual employer reconciliation after the June tax year-end

Nigeria

PAYE to the State IRS by the 10th; pension within 7 working days of payday

Annual employer return (Form H1) by 31 January

Kenya

PAYE, NSSF, SHIF and Housing Levy by the 9th

Annual P9 forms to employees

Tanzania

PAYE and SDL by the 7th; WCF monthly; NSSF by month-end

Semi-annual PAYE and SDL returns (June and December)

Tunisia

Income tax withholding monthly

CNSS social security declarations quarterly; annual employer declaration

1. Botswana

Botswana's new Employment and Labour Relations Act 2025, in force from 1 July 2026, is the biggest change in the region: written contracts for everyone, 12-month limits on fixed-term contracts and a new dispute-resolution commission.

Before the first hire

Register as an employer with BURS for PAYE.

Issue a signed written contract to every employee, including domestic, farm and construction workers.

Review all fixed-term contracts against the new 12-month rule.

Contracts and probation — Fixed-term contracts are limited to 12 months unless objectively justified; probation is capped at 6 months with feedback before termination. Permits are generally limited to 5 years in total and require a plan to train a Tanzanian successor.

Data protection — The Personal Data Protection Act 2022 requires registration of controllers and processors and restricts transfers abroad.

Termination — A valid and fair reason and a fair procedure are required after 6 months' service; disputes go to the Commission for Mediation and Arbitration (CMA).

Watch-list — Annual Finance Act changes to PAYE and SDL; enforcement of the data protection registration regime.

Sources: PwC Tax Summaries – Tanzania · Tanzania Revenue Authority

6. Tunisia

Tunisia's Law 2025-9 is the most far-reaching change in North Africa: open-ended contracts are now the default and labour subcontracting is a criminal offence.

Before the first hire

Register with CNSS for social security and with the tax authority for income tax withholding.

Use open-ended contracts (CDI) unless the role fits one of the limited fixed-term exceptions.

Contracts and probation — Fixed-term contracts outside the permitted cases are reclassified as open-ended, with seniority restored. An own entity makes sense for larger teams, tenders that require local incorporation, or regulated activities. In Tunisia, the 2025 subcontracting ban means arrangements must be structured as genuine employment by a local employer.

Truerix employs staff through its own entities in South Africa, Botswana, Nigeria and Tunisia, and covers Kenya, Tanzania and the rest of Africa through its network.
